International Commercial Arbitration

Question: Discuss about the International Commercial Arbitration. Answer: Introduction: Arbitration can be defined as an ADR process whereby the related parties refer the problem to the third party that has an independent existence. The determination is made by the arbitrator. Arbitration is vital when the matter is technical in the scenario and the parties engaged in a dispute hunts for confidentiality and transparency. Arbitration can be selected on a mutual basis or as per the discretion of the court. Moreover, it can be defined as a method whereby the dispute is registered by an agreement between the parties to a single or more arbitrators and a binding decision is expected on the dispute. Arbitration carries the advantage that the parties vouch for a resolution instead of knocking the court gate. The main features of Arbitration are as follows: Consensual in nature Arbitration can happen when both the parties to the agreement have agreed upon. There are ample scenarios when the future dispute arising in a contract is referred to arbitration and a clause is inserted. Through a submission agreement, a current dispute can be dealt under arbitration. It is different from meditation in the fact that a party cannot step back from arbitration. The arbitrator is selected by the parties to the contract and both have agreed to it. In the case of a single arbitrator, the parties select it. However, when it comes to the three-member tribunal, every party appoints an individual arbitrator further two people agree on the arbitrator that will preside. However, the center can prescribe potential arbitrator that have the expertise and high skills. Neutral No parties to the contract can have a home court advantage. The parties to the contract are able to select factors like law, language and the place of the arbitration. This helps them to have an advantage just like the home court. Confidentiality As per the rules of WIPO, it safeguards the confidentiality of the presence of arbitration and any disclosures provided during the process and even the award. In some scenario, the WIPO rules enable a party to limit the access to secrets of the trade or any other information that is confidential in nature. Decision is final and binding The decision of the arbitral tribunal is final and binding that indicates the parties to the contract need to adhere to it without any delay. The national court enforces the international award that allows them to be kept aside in certain circumstances. The process of arbitration is influenced by the autonomy of the party and hence the choice of action depends entirely on them. Hence, arbitration involves immense flexibility. The parties are in a strong position to select a slow or a fast arbitration. The main reason why arbitration is selected is due to speed, accuracy, and efficiency. When proper plans are into practice then arbitration can be a fast process as compared to litigation and especially when it comes to the process of international arbitration. The flexibility of procedure is termed as the major highlight of arbitration. References Born, Gary. International Commercial Arbitration. Frederick, MD: Wolters, 2014 Jane, Jenkins. The Bell Jar Essays (1310 words) - Julius And Ethel Rosenberg

The Bell Jar Esther and Patriarchy "The Bell Jar", which is written by Sylvia Plath, indicates that patriarchal society has many effects on women. Men have power over women in both direct and indirect ways. In this paper, I would like to concern about Esther and patriarchy. Men use their power directly to oppress Esther. Also they use power indirectly to set up social values and sexual stereotyping which have many effects on Esther. To begin with men's power that affects Esther directly, there is the issue of sexual discrimination that is shown obviously in the novel. In the patriarchal society, men are in-control. Also, men have women in their power. Women are oppressed by men. As for Esther, men have many effects on her life. There are many men who oppress her. Firstly, Marco, who falls in love with his cousin, has almost raped her. He can't have his wish fulfilled because his cousin is going to be a nun. Esther doesn't have any idea that a man who falls in love with his cousin will see her as a material. He curses the word "slut" at her. She is very disappointed. The thing he does with her is one of the causes that make her break down. Secondly, Irwin, whom Esther meets at the library, doesn't have responsibility. Esther wants to get rid of her virginity. Thus, she decides to seduce Irwin because of his qualities. He is the professor and already has a girlfriend. " I felt the first man I sleep with must be intelligent, so I would respect him...I also needed somebody quite experienced to make up for my lack of it...Then, to be on the safe side, I wanted somebody I didn't know and wouldn't go on knowing..." (P.186). After Esther sleeps with Irwin, she has hemorrhage and must go to see a doctor. Irwin makes her feel disappointed because he isn't responsible for the bill for doctor's curing and checkup. Instead of feeling guilty, he asks her to see him again. Thirdly, Doctor Gordon, who is a psychiatrist, hurts Esther by using shock treatments. What Esther really wants is warmness, but Doctor Gordon doesn't give it to her. He diagnoses her illness and uses the method of curing without concerning her mind. " Then something bent down and took hold of me and shook me like the end of the world. Whee-ee-ee-ee-ee, it shrilled,..., and with each flash a great jolt drubbed me till I thought my bones would break and the sap fly out of me like a split plant." (P.117-118). She feels terrible but she doesn't dare to tell Doctor Gordon. She has to keep her feeling secret. If she doesn't do like that, she might have much more shock treatment. Dr. Gordon: "How do you feel?" Esther: "All right" But I didn't. I felt terrible. (P.118) Esther goes to see Doctor Gordon in order to find someone whom can help her and understand her. She finds a man who tortures her. Instead of making her comfort, he hurts her body. He has the right to cure her by using shock treatment. We can see that Doctor Gordon is a man and a doctor. In Patriarchal society, he has power over Esther who is a woman and a patient. Men are able to do what they wish with Esther. Furthermore, men's power which affects Esther indirectly; there are many social values that make women have limits. Men are persons who fix women's roles and duties in the society. They set up these social values and sexual stereotyping which have many effects on Esther. First of all, women are not expected to have talent and intelligence more than men. Although women have ability to study, academic world is not a field of women. Esther can't be highly successful in her career. In the patriarchal society, men have authority. They will determine whether women can live in men's field. " After my month on the magazine I'd applied for a summer school course with a famous writer where you sent in the manuscript of a story and he read it and said whether you were good enough to be admitted into his class." (P.84) Though Esther studies very well, she is rejected to study in

The Adoption And Safe Families Act Social Work Essay Essays

The Adoption And Safe Families Act Social Work Essay Essays The Adoption And Safe Families Act Social Work Essay Paper The Adoption And Safe Families Act Social Work Essay Paper For far excessively many old ages, kids were removed from the place and placed in surrogate attention. For some they would stay at that place until they aged out. For others they returned to places that were unsafe due to the reluctance to take a kid off from the parents, even if they were bad parents. We have clear records of the history of kids in our state placed into orphanhoods merely to be turned out at 18 to fend for themselves. Parents were either non-existent, or volitionally gave their kids up. As a kid aged, it was less likely that they were adopted. ( Crosson-Tower, 2010, pp. 6 A ; 7 ) In 1997, President Clinton signed into act the Adoption and Safe Families Act to assist rectify the current kid public assistance Torahs. This act provided specific guidelines to instance workers and other bureaus to assist kids and households with reunion every bit good as timely acceptances and go oning supportive services. ( Adame A ; Pierce, 2000 ) The chief en d was to treat the kids in either way every bit rapidly as possible and leave no kid without hope of household. The Adoption and Safe Families Act of 1997 The intent of the Adoption and Safe Families Act ( ASFA ) is to restrict the sum of clip a kid spends in Foster attention. The end is to treat kids through the system as rapidly and seasonably as possible. If it is non possible to put the kid back into the place through reunion, the ASFA ensures that no kid is left in surrogate attention longer than necessary. In the past kids were taken out of the place and left in surrogate attention indefinitely or until they aged out. The ASFA corrects this job. Additional, through ASFA, The Family Preservation and Support Services Program know known as Promoting Safe and Stable Families allow support to assist with research, preparation, proficient aid, and funding for Native American folks. Most significantly, through AFSA, the kids and their demands take case in point over all else. ( DePanfilis A ; Salus, 2003 ) Additional support is provided for reding services, reunion services, substance maltreatment intervention, mental wellness, domes tic force, and impermanent child care. ( Adame A ; Pierce, 2000 ) Fundss are besides available for publicity and consciousness of kid maltreatment and child sexual maltreatment as a preventive action to hold or decelerate down kid maltreatment. In add-on to Federal support, every province is allowed extra financess to promote engagement in time-limited reunion for households. ( Summary of The Adoption And Safe Families Act of 1997 ) For old ages, kids that were taken from the place because of kid maltreatment or disregard were typically placed in surrogate attention. Some of these kids neer returned home nor were they adopted. In an effort to diminish the sum of kids falling through the clefts of kid public assistance services, the House of Representatives and Congress restructured the Adoption Assistance and Child Welfare Act of 1980 to include bar services and reunion services every bit good as timely acceptances. In 1997, President Clinton signed the new act into jurisprudence. ( Adame A ; Pierce, 2000 ) ( Summary of The Adoption And Safe Families Act of 1997 ) For many old ages in this state the mentality was that, a parent has a right to raise a kid as they see fit. It was non the usage for kid protective services to take a kid from the place. When such instances happened the kid had two picks, returning to a potentially unsafe place, or passing critical kid goon old ages resiling from one Foster attention place after another. Some of these places were merely every bit insecure as their ain place. Through AFSA, States are requried to do sensible attempts to put a kid up for acceptance by ending the parental rights if the kid has been in surrogate attention for less than two old ages. ( Summary of The Adoption And Safe Families Act of 1997 ) ( Adame A ; Pierce, 2000 ) Further alterations in the jurisprudence pertained to reunitifcation attempts. In the yesteryear, reuniting the households was debatable as there were no services available for these households. As a consequence, when the parents felt they were ready to take back their kid , it was allowed. Case direction did non widen to in place bar services to guarantee the household was run intoing the Childs demands. Many ended up back into the system, or neer made it to their following birthday. ( DePanfilis A ; Salus, 2003 ) AFSA ensures that all States and bureaus adhere to the commissariats and gives funding for bar, intercession, including reunion, every bit good as pre and station adoptive services. Incentive financess for traveling kids frontward in a timely mode are included through AFSA. ( Summary of The Adoption And Safe Families Act of 1997 ) One of the most of import alterations ensuing from AFSA is in respects to particular needs kids. Any kid placed in the system that has limited or particular demands are guaranteed wellness attention coverage by their prospective provinces. The intent is to assist further care households or adoptive households trade with the cost of medical attention, or educational attention associated with a particular needs kid. In old ages past, many of these kids were abandoned by households and the system, because they were non equal campaigners for acceptance. Foster attention households would fight with the costs of caring for a kid with particular demands. In order for a province to be eligible to have financess through AFSA, they are required to supply wellness attention coverage to particular demands kids who are traveling through the acceptance procedure. ( Summary of The Adoption And Safe Families Act of 1997 ) Through this support, many kids who have particular demands, including menta l and behavioural jobs are more likely to have an adoptive household. Without this proviso for support, many who are seen as debatable would hold few options for a healthy place and household environment. ( Adame A ; Pierce, 2000 ) Today through AFSA kids have a opportunity to populate normal healthy lives. Through AFSA they are no longer forgotten by the system. They have more than merely two options, they can travel place with the aid of support services as a follow-up to reunion. If that is non an option that is in the best involvement of the kid, seasonably adotptive services are provided. These services enable a kid to happen a permenant loving place. They are non abandon by the parents, nor by the system.

Burning Fall Leaves May Be Hazardous to Your Health

Burning Fall Leaves May Be Hazardous to Your Health Burning fallen leaves used to be standard practice across North America, but most municipalities now ban or discourage the incendiary practice due to the air pollution it causes. The good news is that many towns and cities now offer curbside pickup of leaves and other yard waste, which they then turn into compost for park maintenance or for sale commercially. And there are other burn-free options as well. Burning Leaves May Spark Health Problems Because of the moisture that is usually trapped within leaves, they tend to burn slowly and thus generate large amounts of airborne particulates- fine bits of dust, soot and other solid materials. According to Wisconsin’s Department of Natural Resources, these particulates can reach deep into lung tissue and cause coughing, wheezing, chest pain, shortness of breath and sometimes long-term respiratory problems. Leaf smoke may also contain hazardous chemicals such as carbon monoxide, which can bind with hemoglobin in the bloodstream and reduce the amount of oxygen in the blood and lungs. Another noxious chemical commonly present in leaf smoke is benzo(a)pyrene, which has been shown to cause cancer in animals and is believed to be a major factor in lung cancer caused by cigarette smoke. And while breathing in leaf smoke can irritate the eyes, nose, and throat of healthy adults, it can really wreak havoc on small children, the elderly and people with asthma or other lung or heart diseases. Small Leaf Fires Can Cause Big Pollution Problems Sporadic individual leaf fires usually don’t cause any major pollution, but multiple fires in one geographic area can cause concentrations of air pollutants that exceed federal air quality standards. According to the U.S. Environmental Protection Agency (EPA), several leaf and yard waste fires burning simultaneously in a particular locale can cause air pollution rivaling that from factories, motor vehicles, and lawn equipment. Fallen Leaves Make Good Compost Purdue University consumer horticulture specialist Rosie Lerner says that composting leaves is the most eco-friendly alternative to burning. Dry leaves alone will take a long time to break down, she says, but mixing in green plant materials, such as grass trimmings, will speed up the process. Sources of nitrogen, such as livestock manure or commercial fertilizer, will also help. â€Å"Mix the pile occasionally to keep a good supply of air in the compost,† she says, adding that a compost pile should be a minimum of three cubic feet and will generate soil conditioner within weeks or a few months, depending on conditions. Mulch Leaves Instead of Burning Another option is to shred leaves for use as mulch for your lawn or to help protect garden and landscape plants. Lerner suggests adding no more than a two-to-three-inch layer of leaves around actively growing plants, chopping or shredding the leaves first so they don’t mat down and prevent air from reaching roots. As to using leaves as mulch for your lawn, it is just a simple matter of mowing right over the leaves with the lawnmower and leaving them there. As with leaves used for garden mulch, this will provide many benefits, including weed suppression, moisture conservation and moderation of soil temperature. Mangin Ethics Essay Example | Topics and Well Written Essays - 500 words

Mangin Ethics - Essay Example This new incentive plan also put pressure on the service advisors, the front-desk counter people who meet the customers and advised them on the repairs to be done, based on recommendations of mechanics. Its good intentions were soon engulfed in the unethical behaviors by both the service advisors and the mechanics because they tend to mislead customers by recommending the repairs that were really unnecessary, just to meet their sales quotas of certain product item-specific parts and thereby earn commissions as well. The factors contributing to this unethical situation was its incentive plan which stokes the greed of employees to earn commissions and also the pressure of meeting the sales quotas imposed by the management of Sears to increase its profits. The ethical approach taken by Sears, Roebuck & Co. was the consequentialist approach because they did not mind how the sales quotas are met or attained by its employees as long as its objective of raising its profits is attained in a highly-competitive environment of auto repairs. Management was desperate to reverse its sales decline and therefore did not mind how to attain a better profit picture as long as it is achieved. In this regard, it is like the saying â€Å"the end justifies the means† which is actually quite Machiavellian in its nature already (Falco, 2004, p. 384). Sears response to the allegations was inadequate because it did not even issue apologies to its customers. Instead, what it did was justify its actions by claiming the repairs were done for purposes of preventive maintenance, especially on older cars. Further, it claimed some errors had been committed but only in rare instances, that the allegations of fraud was not widespread in its store chain. More damaging perhaps was it retained and merely re-designed its incentive plan by excluding the service advisors from commissions but the mechanics are still on

Code Of Ethic Compliance Essay Example | Topics and Well Written Essays - 500 words

Code Of Ethic Compliance - Essay Example Forced! It does not work. A peaceful mind is the first requisite in any endeavor. The tendency of the mind is to wander. The mind has to be kept under intellectual supervision but that is possible only through inducing the right assessment of priorities. Mind reacts to the stimuli from the world, and responds accordingly, but a preoccupied mind leads to a confused response. The first priority of teacher should be to enhance mind concentration or availability to draw the attention totally and completely. Where is the room of any doubt for the one who is convinced that the task is within his capacity This should be the essence of very education. A conducive environment must be created by the educator to build high self confidence and high self esteem within students. Attitude makes the difference. The educator should become a source of positive attitude for the students. Louis A. Berman said "A good teacher is a master of simplification and an enemy of simplism". A educator must promote simple living but high thinking attitude. This greatly helps in intellectual development which in turn will do. According to William Arthur Ward "The mediocre teacher tells. The good teacher explains. The superior teacher demonstrates. The great teacher inspires". An educator has to lead by example. One has to act than to lecture.

A Soccer Story Essay Example for Free

A Soccer Story Essay Snow fluttered to the ground as Jane pulled her gold jersey closer to guard against the blistering chill. Although the miniature goblins and ghouls had just collected their annual treats, winter was already wrapping its bitterly cold hands around her. The soccer field shone, glistening from the already melting snowflakes. Even though championship game had not yet started, the Warrior stadium overflowed with rows of eager fans, enthusiastic to be watching such an important soccer match. The line of girls marched up to the slushy field to meet their adversaries, the Panthers, shivering in their gold soccer shorts. Jane could see the opposing team glance warily at them as if the game was just a waste of their time. In every heart burned the desire to win, to achieve a task never before accomplished. The Lady Warriors were on a mission: to beat the Panthers for the first time in school history. The first forty-five minutes of the game went uneventfully; both teams attempted to score, but the soccer ball was shuttled around the field like a ping-pong ball, aimlessly with no sense of direction. As they battled against their opponents, the harsh and brutal wind attacked the athletes. They had to win. They had to beat the cold. They had to beat the best team, and they had to get even. Whistle blaring, halftime was declared, and the team trudged back through the icy grass, disappointed. The winter chill was barely felt as their unspoken frustration took over. The team circled together and listened to their coachs encouragements. The shrill whistle sounded once again, and the team charged back onto the field, feeling the motivation to win, remembering Coach Smiths last words: Theres nothing you girls cant do. Jane was inspired and she rushed on the field, playing like a maniac. Suddenly, an ear-splitting crack was heard and for a second, there was silence. Perhaps her excitement blinded all other senses, but Jane only remembered seeing a blur moving in her direction before she collapsed on to the snowy field, head throbbing. Head bowed down in defeat, Jane could not bring herself to look up at the crowd surrounding her. But a solitary clap  emanated from the row of spectators, and as she lifted up her tear-streaked face, her eyes locked with those of her optimistic team mates. Unsteadily, Jane stood up and the stadium resounded with cheers. The game commenced promptly; the clock was ticking with no time to lose. Then, the words, the assertion, that made Janes fists clench, a single statement uttered by the rival coach: That girls weak, one charge at her, and shell be down again. That girl was Jane, the offensive player, the unnerving forward, and she was enraged. Stinging pain from where the ball made contact with bare skin was quickly forgotten, even as the ugly red marks remained. The biting wind whipped strands of hair in her face, and Janes eyes squinted in the icy coldness. But her mind was defiantly set: she was on a mission to score. Adrenaline rushed through her bloodstream and her heart pounded rapidly as she rushed down the field. Jane swiftly maneuvered the ball with exact precision, imagining the moment the ball would enter the opponents goal. It was amazing how much satisfaction one solitary act could reward a person. One moment the white jersey of the defensive girl was coming at Janes way, ready to charge and steal the ball away. At the next instant, the sky was looking quite beautiful, sun shining, as the ball sailed swiftly into the white net. The whistle sounded shrilly and the multitude of onlookers erupted with excitement, the Warriors had defied an age old tradition, defeating the long-standing champions. The accomplishment, the pain-it made Jane triumphant that day. Against the odds, the underdog emerged victorious on the battlefield.
